Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Keipe Creative Studio LLC ("The Drop," "we," "us," or "our") governing your use of The Drop mobile app and related services (the "Service"). By creating an account, playing as a guest, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service you represent that you meet the age requirement and can form a binding contract.
2. Your account and handle
You are responsible for your account and for activity under it. Handles are randomly generated display names — you may reroll them but may not impersonate others or use offensive names. Guest sessions are temporary and may be lost when you sign out.
3. The game — entertainment only; no real-money gambling
The Drop is a golf party game for entertainment. In-game "Drops," points, and any scoring or "settle-up" features use play money / bragging rights only and have no monetary value, are not redeemable, and are not gambling. If you and other players choose to make wagers among yourselves in the real world, that is solely between you and those players; The Drop is not a party to, does not facilitate, and is not responsible for any such wagers. Play responsibly. References to a beverage cart or drinks are part of the game's humor and are not encouragement to consume alcohol; if you drink, do so legally and responsibly.
4. Play safely
Golf is a physical activity played in outdoor environments. You are responsible for your own safety and for following the rules, etiquette, and policies of any course you play. Do not use the app in a way that distracts you from playing safely or that violates course rules.
5. Acceptable use
You agree not to: (a) use the Service unlawfully or to harass, abuse, or harm others; (b) cheat, exploit, reverse engineer, scrape, or disrupt the Service; (c) infringe others' rights; or (d) submit unlawful, infringing, or harmful content.
6. User-submitted content
You may submit Drop suggestions or similar content. You retain ownership of what you submit, but you grant us a worldwide, royalty-free, perpetual, sublicensable license to use, reproduce, modify, and incorporate it into the Service (including future Drop decks) without obligation or compensation. We may review, edit, decline, or remove submissions at our discretion. Do not submit content you don't have the right to share.
7. Subscriptions and purchases
The Service is currently free. We may offer optional paid features (e.g., a "PRO" subscription) in the future. If we do: purchases are processed by the applicable app store (Apple App Store / Google Play), subject to that store's terms; auto-renewable subscriptions renew automatically at the then-current price unless canceled at least 24 hours before the end of the current period; you manage and cancel subscriptions in your app store account settings; and pricing, billing periods, and what's included will be disclosed at the point of purchase.
8. Intellectual property
The Service, including its software, design, text, graphics, logos, and the "The Drop" name and marks, is owned by us or our licensors and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial entertainment. All rights not granted are reserved.
9. Third-party services
The Service relies on third parties (e.g., app stores, cloud hosting, push delivery, and course data providers). We are not responsible for third-party services, and your use of them may be subject to their terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or accurate (including course data and scoring).
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF USD $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or others' rights.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive (e.g., IP, disclaimers, liability) survive termination.
14. Changes to these Terms
We may update these Terms. We will post the updated version with a new effective date and, where appropriate, notify you in the app. Continued use after changes means you accept them.
15. Governing law and disputes
These Terms are governed by the laws of the State of Colorado USA, without regard to conflict of law rules.
